LEGAL
Terms of Service
The terms and conditions governing bookings, travel services, and La'gullez Travel Club membership.
Company & Scope
La'gullez Travel & Tours operates in the Republic of Zambia. These Terms & Conditions apply to all travel services, experiences, and the La'gullez Travel Club.
By booking a service, paying a deposit, or joining the La'gullez Travel Club, you agree to be bound by these Terms.
Bookings, Quotations & Payments
Please review the booking, quotation, and payment rules below before confirming any service with us.
Confirmation
All bookings are subject to availability and are confirmed only upon receipt of the required deposit and written confirmation from us.
Quotations
Quotation prices are valid for 14 days from the issue date. Prices may change after 14 days due to currency exchange fluctuations, airline fare changes, supplier rate adjustments, or government tax modifications. Confirmed bookings with paid deposits will be honored at the quoted rate except under extraordinary circumstances.
Payment Schedule
A minimum 50% deposit is required at booking unless specified otherwise in writing. Full payment must be completed at least thirty (30) days prior to departure. Failure to settle payments on time may result in booking cancellation under Section 4.
La'gullez Travel Club
The La'gullez Travel Club is a savings-based membership program designed to help clients finance future travel.
Non-Refundable Contributions
Membership fees and monthly installments are non-refundable except where we fail to fulfill our obligations or cease operations.
Redemption
Benefits are subject to availability, completion of the contribution schedule, and are non-transferable without written consent.
Withdrawal
Members may withdraw with 90 days' written notice. The initial membership fee is forfeited, and accumulated contributions are returned minus a 15% administrative fee.
Closure
In the event of program closure, member contributions will be refunded on a pro-rata basis after settling third-party supplier obligations.
Cancellations & Refunds
Client-Initiated Cancellation Fees
Note: Third-party supplier cancellation fees (airlines, hotels, activity providers) apply in addition to these terms. No refunds are granted for no-shows, unused tour components, or voluntary departure after a trip has commenced.
Passports, Visas & Travel Documentation
Clients are solely responsible for obtaining and holding valid passports (valid for at least 6 months past the return date), required entry visas, health certificates, and vaccination records. While we provide general travel advice, we recommend confirming entry rules directly with relevant embassies. We accept no liability for denied boarding or entry refusal due to incorrect documentation.
Health, Safety & Travel Insurance
Your safety is paramount. The following policies apply to all bookings:
Mandatory Insurance
Comprehensive travel insurance covering emergency medical expenses, evacuation, trip cancellation, and personal liability is mandatory for all bookings. Proof of insurance must be provided before final payment acceptance.
Waiver
Clients who decline insurance coverage do so entirely at their own risk and must sign a formal liability waiver.
Health Declarations
Participants must disclose any pre-existing medical conditions that could affect safe participation in tour activities. Participation in all activities is undertaken at the client's own risk.
Force Majeure & Service Disruptions
We are not liable for delays, changes, or cancellations caused by events beyond our reasonable control (force majeure), including natural disasters, weather events, wars, civil unrest, strikes, pandemics, government restrictions, airport closures, or supplier failures.
In the event of Force Majeure:
- We will make reasonable efforts to offer alternative travel arrangements.
- If alternatives cannot be arranged, clients may receive a credit voucher valid for 24 months for unused service portions.
- We will refund amounts successfully recovered from suppliers, minus administrative costs.
Acceptable Website Use & Intellectual Property
Website Rules
You agree not to misuse our website, submit false information, attempt unauthorized administrative access, or interfere with site operations.
Ownership
All website content, logos, branding (“Because Memories Deserve Luxury”), and media are owned by or licensed to La'gullez Travel & Tours. Unauthorized copying, distribution, or reproduction is prohibited.
Limitation of Liability
Agency Role
La'gullez Travel & Tours acts as an agent for third-party travel suppliers (airlines, hotels, transport operators). We are not liable for negligent acts, errors, or service defaults committed by these external suppliers.
Financial Cap
To the maximum extent permitted by law, our total liability for any claim arising from our services shall not exceed the total amount paid by the client for that specific booking.
Statutory Protections
Nothing in these terms excludes liability for fraud, gross negligence, willful misconduct, death/personal injury caused by negligence, or consumer rights protected under applicable laws, including the Competition and Consumer Protection Act No. 24 of 2010 (as amended).
Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of Zambia.
If a dispute arises, clients agree to first attempt informal resolution by contacting us in writing. If unresolved, clients may lodge a formal complaint with the Competition and Consumer Protection Commission (CCPC):
Plot 3827 Parliament Road, Olympia Park, Lusaka
Clients may also seek remedies under applicable Zambian law.
